Luigi Mangione, accused of murdering United Healthcare CEO Brian Thompson in Midtown Manhattan, is set to return to court Tuesday for further testimony. The presiding judge is considering whether to exclude crucial evidence in the state murder case.
On Monday, Judge Gregory Carro listened to a 911 call made by a McDonalds employee in Altoona, Pennsylvania. The worker reported that customers were concerned the suspect in Thompsons shooting was inside the restaurant.
Two corrections officers from SCI Huntingdon, where Mangione was held before being extradited to New York, testified about statements Mangione allegedly made, including claiming he carried a 3D-printed gun in his backpack. Mangiones defense attorneys are attempting to have this evidence excluded, arguing the backpack search was conducted without a warrant and that he was not read his Miranda rights.
The backpack reportedly contained a firearm, ammunition, and a notebook of Mangiones writings. Five witnesses testified Monday, and prosecutors indicated they could call more than 25 in total. The hearing is expected to continue for several days.
Details of the 911 Call
Prior to Monday, few details were known about the 911 call that led to Mangiones capture, ending a five-day nationwide manhunt. The call was made at 9:14 a.m. on December 9, 2024, by a McDonalds manager. Calmly, she informed the dispatcher that a man in the restaurant matched the description of the CEOs shooter, sitting near the bathrooms with a pharmacy bag, wearing a black jacket, tan beanie, and a medical mask. The dispatcher confirmed that an officer was on the way.
Corrections Officers Testify
Officer Matthew Henry testified that Mangione disclosed having a backpack containing a 3D-printed gun, ammunition, and foreign currency on December 10, 2024. Henry stated he did not write down the statements or share them until questioned by the Manhattan District Attorneys office months later. He said he had no casual conversations with Mangione.
Defense attorney Marc Agnifilo questioned whether Mangione simply volunteered the information or if Henry later fabricated the details. Henry confirmed he only responded when asked direct questions about the prison.
Another officer, Tomas Rivers, monitored Mangione starting December 16, 2024, emphasizing that SCI Huntingdon wanted to avoid an Epstein-style situation. Rivers described discussions with Mangione about healthcare differences worldwide and media coverage of the case. Rivers said he never reported these conversations until questioned by the Manhattan DA and was not investigating the crime during the interactions.
Defense Seeks to Exclude Statements
Mangiones lawyers aim to have all statements he made from his arrest on December 9 until his transport to New York on December 19, 2024, excluded. Prosecutors began by presenting an NYPD officer and the McDonalds security camera installer to introduce video and photo evidence tracing Mangione from the murder scene to his arrest.
Evidence shown included footage of Thompson being shot on a Manhattan sidewalk and surveillance images from a Starbucks, a hostel, a taxi, and inside the McDonalds where Mangione was arrested. Police arrived at the restaurant shortly before 10 a.m., with at least eight officers on site. The videos presented had no audio.
