Maurene Comey's legal action could face an obstacle

On Thursday, a federal judge indicated openness to a request that could postpone former federal prosecutor Maurene Comeys lawsuit against the Trump administration. Instead of moving forward in federal court, Comey might be required to present her claims of wrongful termination to the Merit Systems Protection Board (MSPB).

U.S. District Judge Jesse Furman, appointed by President Barack Obama, remarked in court that Whether this court has jurisdiction is a substantial question. The lawsuit challenges Comeys abrupt dismissal in July, which she claims was unlawful and unconstitutional.

Comeys attorneys argued that sending the case to the MSPB could be ineffective, as the board has been weakened under the Trump administration. Ellen Blain, representing Comey, stated, This is not a routine employment case. This is fundamentally about the separation of powers, and emphasized that referring the matter to the MSPB would likely be entirely futile.

The hearing was a notable return to Manhattan federal court for Comey, daughter of former FBI Director James Comey, who spent nearly ten years as a prosecutor in the same district. She has been involved in high-profile prosecutions, including cases against Jeffrey Epstein and Ghislaine Maxwell.

Despite the tense situation, Comey appeared composed, greeting a security officer warmly as she entered. Several former colleagues attended the hearing, including attorney Ellen Blain and Judge Furman, both of whom had previously worked with her.

Comeys legal team acknowledged they plan to use discovery to determine whether President Trump directly ordered her termination. Judge Furman noted that this process might raise complex issues, including the possibility of deposing high-ranking officials.

Although the case is being heard in Manhattan, the government is represented by attorneys from the U.S. attorneys office for the Northern District of New York, after Comeys former office recused itself. John Sarcone III, a U.S. attorney from upstate New York and known Trump supporter, attended the hearing but did not speak, sitting alongside the attorney handling the case. Earlier, another judge had suggested Sarcone might need to be disqualified from the proceedings.
